Mohawk Smoke's pricing reflects the tax framework that applies to tobacco produced and sold in connection with First Nations reserve lands under Section 87 of the Indian Act — the same legal foundation that has governed on-reserve commerce and taxation since before Confederation, and which the Supreme Court of Canada has interpreted and affirmed in cases including Nowegijick v. The Queen (1983) and Mitchell v. Peguis Indian Band (1990). This is why prices for native tobacco products differ from mainstream retail pricing, which carries the full weight of federal and provincial tobacco taxation.
